Background

The Var Primary Health Insurance Fund appealed a January 26, 2022 judgment issued in its social-security dispute with Société technique de propreté industrielle. On October 21, 2022, the appellate court declared the notice of appeal lapsed after the Fund failed to appear without a legitimate reason. That ruling was served on November 3, 2022.

Article 468 of the Code of Civil Procedure permits an appellant to seek reversal of such a declaration by informing the court registry, within 15 days, of a legitimate reason that could not have been raised in time. On November 18—the final day of that period—the Fund emailed the registry seeking reinstatement. It also sent a request by registered letter on November 21.

The Besançon Court of Appeal held that the emailed request was inadmissible and ineffective because a procedural act, particularly one initiating proceedings, could not be submitted to the court by email. It rejected the registered letter as untimely. The Fund appealed to the Court of Cassation.

The Court’s Holding

The Court of Cassation quashed the appellate judgment in its entirety. It held that a request to reverse a declaration that an appeal has lapsed may be made by an email sent within Article 468’s 15-day period. The Besançon court therefore erred by treating the Fund’s timely email as categorically inadmissible and without effect.

The Court emphasized that the lower court should instead have examined whether the November 18 email stated a legitimate reason that the Fund had been unable to invoke in time. It remanded the parties to their prior procedural position and sent the case to the Dijon Court of Appeal for that determination.

The company was ordered to pay costs and €3,000 to the Fund under Article 700 of the Code of Civil Procedure; its own Article 700 request was denied.

Key Takeaways

  • An appellant may submit an Article 468 request to reverse the lapse of an appeal by email to the court registry.
  • The email must be transmitted within 15 days and must disclose a legitimate reason that the appellant could not raise in time.
  • A court may not reject such a request solely because email was used; it must examine whether the message contains the required legitimate reason.

Why It Matters

The decision confirms that Article 468 does not impose a formal filing method that excludes email. For practitioners, timely delivery to the registry can preserve a request to reinstate a lapsed appeal even when it is made electronically.

The ruling does not itself reinstate the Fund’s appeal or decide whether its explanation was legitimate. That issue remains for the Dijon Court of Appeal on remand.
