Background

M. [I] [M] was summoned before the Paris tribunal correctionnel in immediate-appearance proceedings on charges of aggravated death threats and contempt (outrages) committed against a judge of the Paris Court of Appeal. By judgment of 7 May 2026, the trial court ordered a psychiatric examination of the defendant, placed him under judicial supervision (contrôle judiciaire), and adjourned the case to a hearing on 19 January 2027. On 15 May 2026, M. [M] applied to the liberty and custody judge (juge des libertés et de la détention) for the lifting of his judicial supervision; by order of 22 May 2026, that judge rejected the request. M. [M] appealed, and by judgment of 8 July 2026 the investigating chamber (chambre de l’instruction) of the Paris Court of Appeal, 1st section, confirmed the order ruling on his request to modify the judicial supervision. He then lodged a pourvoi to the Court of Cassation. Supplementary and personal memoranda were filed.

The appeal was heard by the Criminal Chamber sitting in the restricted formation provided for in Article 567-1-1 of the Code of Criminal Procedure. The case came before the Court on the report of M. Michon, conseiller référendaire and reporting counsellor, the observations of SCP Bauer-Violas, Feschotte-Desbois et Sebagh, counsel for M. [I] [M], and the conclusions of Advocate General M. Micolet, following argument at the public hearing of 4 November 2026 attended by M. Bonnal, president, M. Michon, reporting counsellor, M. Wyon, counsellor of the chamber, and Mme Dang Van Sung, chamber clerk. After deliberating in accordance with the law, the chamber so composed rendered the present judgment.

The Court’s Holding

The Court first held that the first, second, third, fifth and sixth grounds advanced by M. [M], and the first ground advanced on his behalf, were not of a nature to permit admission of the pourvoi within the meaning of Article 567-1-1 of the Code of Criminal Procedure. It therefore examined only the fourth ground proposed by M. [M] and the second ground proposed for him, which it joined. Those grounds criticized the appealed judgment for rejecting the request to modify the judicial supervision — notably the weekly reporting obligation (obligation de pointage) — on the basis of mere assertions, and for confirming the 22 May 2026 order without specifying the circumstances justifying continued supervision as a safety measure, without examining the proportionality of the weekly reporting obligation, and without responding to the argument that the psychiatric-treatment obligation was a sufficient guarantee or that monthly reporting would suffice, allegedly in breach of Articles 137 and 593 of the Code of Criminal Procedure.

The Court rejected those grounds. It noted that, to refuse the modification, the appealed judgment stated that the obligations set by the Paris tribunal correctionnel and confirmed by the liberty and custody judge appeared appropriate to the nature of the facts — committed against a judge in the exercise of her functions — and to the defendant’s personality as established by the proceedings and confirmed by documents communicated by his counsel, including those relating to a compulsory hospitalization. The judges added that the prohibition on attending the Paris Court of Appeal was necessary to give effect to the no-contact prohibition protecting the judge, and was adapted and proportionate because the defendant could attend that court in proceedings concerning him when summoned. As to the reporting obligation, they specified that it was necessary to guarantee his appearance in court.

The Court concluded that, in so ruling, by reasons falling within its sovereign assessment and characterizing the necessity of the supervision measures as a safety measure, the investigating chamber justified its decision, inasmuch as (dès lors que) the judge is not required to give reasons for each of the modalities of judicial supervision other than those for which Article 138 of the Code of Criminal Procedure lays down particular conditions for their imposition. The grounds therefore had to be dismissed.

Key Takeaways

  • Grounds not of a nature to permit admission under Article 567-1-1 CPP are excluded without merits review; here, five of the defendant’s six grounds and one ground filed on his behalf were so excluded.
  • On the joined, admitted grounds, the Court upheld the investigating chamber’s confirmation of the order maintaining judicial supervision, including the weekly reporting obligation, as justified on the facts.
  • The Court’s Article 138 reasoning was expressly circumstance-bound: because the lower judges had given reasons characterizing the necessity of the measures as a safety matter, the judge was not required to justify each supervision modality individually, except those subject to particular statutory conditions.
  • The prohibition on attending the Paris Court of Appeal was upheld as necessary and proportionate, given the exception allowing attendance when summoned in his own proceedings.

Why It Matters

The decision illustrates the operation of the Article 567-1-1 screening mechanism in criminal cassation practice: most grounds were filtered out at the threshold, and only two were examined on the merits before being dismissed. It also confirms, in the specific circumstances presented, that an investigating chamber maintaining judicial supervision need not separately justify every modality of that supervision — such as the frequency of a reporting obligation — provided its reasons establish the necessity of the measures as a safety matter, and subject to the particular conditions Article 138 attaches to certain obligations.

Disposition: REJETTE le pourvoi. Ainsi fait et jugé par la Cour de cassation, chambre criminelle, et prononcé par le président en son audience publique du quatre novembre deux mille vingt-six.
